Terms of service
ZS Projects Inc.
Last updated: Oct 24, 2026 ·
1. Agreement and Acceptance
These Terms of Service ("Terms") govern all services provided by ZS Projects Inc. ("ZS Projects", "we", "us", "our") and the use of our website, zsprojects.ca. "Client" or "you" means the person or business named on the quote or invoice, or anyone using our website.
By signing or approving a quote, paying a deposit or invoice, booking a service online, or allowing our crew to begin work, you agree to these Terms. Please read them carefully, especially Section 3 (Liability Waiver and Release), which limits your legal rights.
If a signed quote or written contract conflicts with these Terms, the signed quote or contract governs for that conflict only.
ZS Projects provides residential and commercial services including snow removal, landscaping, fencing, concrete, painting, framing, contracting, renovations, and towing and transport through ZS Towing and Transport.
2. General Service Terms (All Services)
2.1 Quotes. Quotes are valid for 30 days unless stated otherwise. Quotes are based on site conditions visible at the time of estimate. Hidden or unforeseen conditions (buried utilities, rot, rock, poor soil, structural issues) may require a written change order and additional cost.
2.2 Scope of Work. We perform only the work listed on the signed quote. Any additional work requires a change order or separate quote, approved by you in writing (email or text is acceptable).
2.3 Payment.
- A deposit may be required before work is scheduled. Deposits are non-refundable once materials are ordered or the job is scheduled.
- Balances are due on completion unless the quote states otherwise.
- All prices are in Canadian dollars and exclude GST unless stated.
- Overdue balances may be charged interest of 2% per month (26.8% per year). We may suspend service until accounts are brought current.
- You are responsible for reasonable collection costs, including legal fees, on unpaid accounts.
- Where permitted, we may register a lien under Alberta's Prompt Payment and Construction Lien Act for unpaid amounts.
2.4 Scheduling. Start and completion dates are estimates. Weather, material availability, permits and other factors outside our control may cause delays. Delays do not entitle you to cancel or withhold payment.
2.5 Client Responsibilities. You agree to:
- Give our crew safe, clear access to the work area, including power and water where needed.
- Mark and disclose all private underground items (sprinkler lines, low-voltage wiring, gas lines, septic, invisible pet fences). We are not responsible for damage to unmarked private lines.
- Confirm property lines. Fencing and landscaping are placed where you direct; you are responsible for any boundary disputes.
- Obtain HOA, condo board or landlord approval where required.
- Remove or secure vehicles, furniture, décor, valuables, toys, hoses, cords and other items from the work area.
- Keep children, pets and other people away from the work area while we are working.
- Tell us in advance about any hazards on the property.
2.6 Permits and Utility Locates. Unless the quote says otherwise, you are responsible for permits. We will request public utility locates (Utility Safety Partners) for digging work.
2.7 Photos. We may photograph completed work for our records and marketing. We will not publish your address or personal details.
2.8 Right to Refuse. We may refuse or stop work at any time if conditions are unsafe, access is blocked, or our crew is treated abusively.
3. Liability Waiver, Release and Indemnity
PLEASE READ THIS SECTION CAREFULLY. BY ACCEPTING THESE TERMS, YOU GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE ZS PROJECTS FOR CLAIMS ARISING FROM NEGLIGENCE.
3.0 Applies to All Clients and Services. This Section applies equally to residential and commercial clients, and to every service we provide, including snow removal, landscaping, fencing, concrete, painting, framing, contracting, renovations, and towing and transport. For commercial clients, "you" includes the business, property owner, property manager, landlord, tenant, condominium corporation or any other party that approves the quote, and binds them for claims by their employees, tenants, customers, visitors and members of the public.
3.1 You Remain the Occupier. You remain the owner and occupier of your property at all times, including under Alberta's Occupiers' Liability Act. Hiring ZS Projects does not transfer to us your responsibility for the safety of your property or the people on it.
3.2 Release and Waiver of Claims. To the maximum extent permitted by law, you release, waive and forever discharge ZS Projects Inc., its directors, officers, employees, subcontractors and agents from any and all claims, demands, losses, damages, costs and liability of any kind arising from or related to our services or the condition of your property, including claims caused by the negligence of ZS Projects, for:
- Death, personal injury or illness to any person, including you, your family, tenants, employees, customers, guests, visitors and members of the public;
- Slips, trips and falls on any surface, including driveways, walkways, sidewalks, steps, stairs, ramps, parking lots, decks, patios, lawns, wet or freshly painted surfaces, uneven ground, and newly placed concrete, gravel or sod;
- Ice, black ice, refreeze, frost, slush, meltwater, snow piles, snow banks, and snow or ice falling from roofs, eaves or trees;
- Damage to property, including lawns, turf, shrubs, trees, gardens, landscaping, curbs, edging, pavers, asphalt, concrete, gravel, fences, gates, siding, garage doors, vehicles, mailboxes, lighting, irrigation, and underground or unmarked items;
- Damage caused by de-icing products, salt, sand or other traction materials;
- Cracking, settling, heaving, shrinkage, scaling or discolouration of concrete or masonry;
- Paint overspray, drips, fumes, odours or reactions to paint or cleaning products;
- Any hazard on the property that existed before, during or after our work.
3.3 Ice and Winter Hazards. Snow removal does not make a surface safe or ice-free. Ice can form at any time after we leave. You are solely responsible for monitoring your property and for applying ice melt, sand or other measures between our visits and after our work.
3.4 Indemnity. You agree to indemnify, defend and hold harmless ZS Projects and its directors, officers, employees, subcontractors and agents from any claim, lawsuit, demand, loss or cost (including legal fees) brought by any third party— including tenants, guests, customers, employees, visitors, neighbours or members of the public — for injury, death or property damage on or near your property, including slip-and-fall claims.
3.5 Limitation of Liability. If, despite this Section, ZS Projects is found liable for any reason, our total liability will not exceed the amount you paid us for the specific service that gave rise to the claim. We are not liable for any indirect, incidental, special, punitive or consequential damages, including loss of use, loss of income, business interruption, or temporary accommodation costs.
3.6 Pre-Existing Conditions and Third Parties. We are not responsible for pre-existing damage or defects, or for acts of third parties, including neighbours, municipal plows and crews, utility companies, other contractors, or vehicles.
3.7 Equipment Hazards. You are responsible for removing hazards such as extension cords, hoses, downspout extensions, rocks, toys and décor. We are not responsible for damage to these items, and you are responsible for any damage they cause to our equipment or injury they cause to our crew.
3.8 Reporting Damage. Any claim for damage must be reported to us in writing, with photos, within 48 hours of the service visit. Claims not reported within 48 hours are waived.
3.9 Insurance. You agree to keep adequate homeowner's, tenant's or commercial general liability insurance for your property. Commercial clients agree that their insurance will respond first to any claim arising on their premises.
3.10 Force Majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including severe weather, blizzards, extreme cold, natural disasters, equipment breakdown, fuel shortages, illness, labour shortages, road closures or government orders.
3.11 Acknowledgement. You confirm that you have read and understood this Section, that you had the opportunity to ask questions or seek legal advice, and that you accept these terms voluntarily.
4. Snow Removal Services
4.1 Season and Service Area. The 2026–2027 season runs from November 1, 2026 to April 30, 2027. Heavy snowfalls often occur in March and April, so these months are covered in full. Snow removal is offered in Calgary and Chestermere and surrounding areas.
4.2 When We Clear.
- Residential service is triggered when accumulation reaches 2 cm or more. Commercial service is triggered when accumulation reaches 2 inches (5 cm) or more. Smaller snowfalls are cleared once the total reaches the applicable threshold.
- We clear after snowfall has stopped. We do not clear during active snowfall.
- If snow is forecast to continue for more than 12 hours, we wait until the event ends. We do not make multiple visits during one snowfall event.
- We do not clear snowfalls expected to melt within 24 hours.
4.3 Completion Time. We aim to clear your property within 24 hours after snow stops. During major storms this may take up to 48 hours.
4.4 Weather Limits.
- High winds: We do not clear during sustained winds over 40 km/h or gusts over 60 km/h, because snow re-accumulates quickly.
- Blizzards and heavy snowfall: Response times may be longer; routes are completed as quickly as safely possible.
- Extreme cold warnings: Only fresh snowfall is cleared. Extra or special requests are paused until conditions improve.
4.5 Holidays. On Christmas Day, New Year's Day, Good Friday and Easter Sunday, snowfalls of 5 cm or less are cleared the next day. Snowfalls over 5 cm are serviced on the normal schedule.
4.6 Equipment. We may use snow blowers, plows, shovels, scrapers, brooms and other tools as needed. A thin layer of snow, slush or ice may remain after clearing.
4.7 What Is Not Included.
- Ice removal, chipping or salting are not included unless listed on your quote. You remain responsible for ice control.
- Driveways with rubber paving.
- Roofs, decks and balconies, unless listed on your quote.
- Snow hauling or removal of windrows left by city plows, unless listed on your quote.
- Home-based business properties (unless covered by a commercial quote).
4.8 Gravel and Surfaces. We are not responsible for gravel, rocks or debris moved onto lawns or beds from gravel driveways, or for scuffs or scratches to pavers, stamped concrete, asphalt or edging.
4.9 Marking. Please mark the edges of driveways, walkways, garden beds and obstacles before the first snowfall. We are not responsible for damage to unmarked items hidden under snow.
4.10 Snow Placement. Snow is piled on your property in the most practical location. We do not move snow onto neighbouring properties or public roads, and are not responsible for melt or drainage from snow piles.
4.11 Payment.
- Choose a full-season payment upfront or monthly payments.
- Monthly payments are due in advance on the 1st of each month. The first month is due at sign-up.
- Service is suspended for any month that is not paid. No credit or refund is given for snowfalls missed during a suspension.
- Seasonal pricing is fixed regardless of how much or how little it snows.
4.12 Service Requests and Concerns. Extra work beyond your contract should be requested through our office and will be scheduled the following day. If anything is missed, contact us within 24 hours so we can correct it.
5. Landscaping, Fencing, Concrete, Painting and Renovations
5.1 Landscaping and Sod. Plants, trees, shrubs and sod are living materials. Once installed, you are responsible for watering, care and maintenance. We do not guarantee plant survival. Grade and drainage work is done to reasonable visual standards; we are not responsible for drainage problems caused by soil type, neighbouring properties or existing grading.
5.2 Fencing. Fences are installed on the line you direct. You are responsible for confirming property lines (a real property report or survey is recommended) and any neighbour agreements. Natural wood may crack, warp, twist, shrink or change colour; this is not a defect. Ground heaving from frost may move posts over time.
5.3 Concrete. Concrete naturally cracks, and hairline or shrinkage cracks are not defects. We are not responsible for cracking, heaving, settling, scaling or spalling caused by frost, soil movement, de-icing salts, heavy vehicles or improper care. Keep vehicles off new concrete for at least 7 days and do not use salt on it during its first winter. Colour and finish may vary between pours.
5.4 Painting. Paint colour and sheen may look different from samples or screens due to lighting and surface. We are not responsible for existing surface defects, peeling caused by moisture or previous coatings, or reactions to paint odours or fumes. Keep people and pets off wet surfaces until fully dry. Exterior painting depends on suitable temperature and weather.
5.5 Renovations and Contracting. Work behind walls, floors and ceilings may reveal hidden conditions such as rot, mould, asbestos, outdated wiring or structural issues. Repairs to these conditions are extra and require a change order. Where required, licensed trades (electrical, plumbing, gas) will be used or must be arranged by you.
5.6 Workmanship Warranty. We warrant our workmanship for one (1) year from completion, unless your quote states otherwise. This warranty covers defects in our installation only and does not cover:
- Normal wear and tear, weathering or natural material characteristics;
- Damage from frost, soil movement, flooding, extreme weather or acts of nature;
- Misuse, neglect, lack of maintenance, or alterations by others;
- Materials supplied by the client;
- Plants, sod and other living materials.
The warranty is void if the account is not paid in full. Our sole obligation under the warranty is to repair or replace the defective workmanship, at our option. Manufacturer warranties on materials are passed on to you as provided by the manufacturer.
5.7 Clean-Up. We remove our debris and leave the work area broom-clean. Minor disturbance to surrounding lawn or soil from equipment access is normal and not considered damage.
6. ZS Towing and Transport
6.1 Services. ZS Towing and Transport, a division of ZS Projects Inc., provides light and medium duty towing, vehicle transport, long distance towing, roadside assistance, recovery and battery boosts. We do not tow box trucks. Towing is offered in Calgary, Cochrane, Okotoks, Airdrie, Canmore, Banff and Lake Louise.
6.2 Authorization. By requesting a tow or transport, you confirm that you are the owner of the vehicle or are authorized by the owner to request the service. You are responsible for giving us an accurate location, destination and vehicle description.
6.3 Payment and Vehicle Release. Towing, transport and roadside services are due in full on completion, before the vehicle is released, unless agreed otherwise in writing. To the extent permitted by Alberta law, we may hold the vehicle until the account is paid.
6.4 Personal Belongings. Please remove valuables and personal items before your vehicle is towed or transported. We are not responsible for loss of or damage to items left in the vehicle.
6.5 Vehicle Condition. Our driver may photograph and note the vehicle's condition before loading. We are not responsible for:
- Pre-existing damage, rust, wear or mechanical or electrical faults;
- Damage to low-clearance, lowered or modified vehicles, spoilers, body kits, aftermarket parts or underbody components;
- Damage that is reasonably necessary to recover a vehicle from a ditch, snowbank, mud, water or other difficult location;
- Electrical, battery or electronic damage resulting from a boost;
- Damage caused by road, traffic or weather conditions beyond our control.
6.6 Response Times. Arrival times are estimates. Weather, road conditions, traffic and call volume may cause delays, and delays are not grounds for a refund or discount.
6.7 Damage Claims. Any claim of damage caused by our service must be reported in writing, with photos, before the driver leaves or within 24 hours of drop-off. Claims not reported within this time are waived.
6.8 Liability. Section 3 (Liability Waiver, Release and Indemnity) applies in full to all towing, transport and roadside services.
6.9 Cancellations. Cancellations for towing and transport are covered by our Refund Policy.
7. Cancellation and Refunds
7.1 Snow Removal Contracts.
- Cancellation requires at least 2 weeks' written notice.
- Monthly contracts: a $100 cancellation fee applies.
- Full-season contracts: may only be cancelled with a penalty equal to one (1) month's payment (the full-season price divided by the number of months in the season).
- Payments for the current month are non-refundable. Prepaid amounts for full months remaining after the notice period are refunded, less the applicable cancellation fee or penalty.
- Services cannot be exchanged or transferred to another property or person without our approval.
7.2 Project Work (Landscaping, Fencing, Concrete, Painting, Renovations). If you cancel after approving a quote, you are responsible for the cost of materials ordered (including custom or non-returnable materials), work completed to date, and any restocking fees. Deposits are non-refundable once materials are ordered or the job is scheduled.
7.3 Cancellation by ZS Projects. We may cancel any contract at any time, including for non-payment, unsafe conditions or abusive behaviour toward our crew. If we cancel, the current month's or work-to-date charges are not refunded, and prepaid amounts for future months or unstarted work are refunded.
7.4 Online Purchases. Services booked through our website are subject to these Terms and our Refund Policy.

9.2 Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent permitted by law, and the rest of these Terms will remain in full effect.
9.3 Statutory Rights. Nothing in these Terms limits any right that cannot be limited or waived under Alberta's Consumer Protection Act or other applicable law.
9.4 Entire Agreement. These Terms, together with your signed quote, invoice and our posted policies, are the entire agreement between you and ZS Projects and replace any prior versions, discussions or promises.
